Access Genesee County Court Records

Start with the court, not the county. In Genesee County, the clerk of the court that handled the case holds the authoritative file, and that office answers questions about viewing, copying, and certifying records. A Genesee County court record search moves through a few distinct products: a public case index, a register of actions, an inspected court file, a plain document copy, and a certified copy. Each one carries different weight and a different access route. So the first step is identifying the court and the case number, then using the public search system or contacting the right clerk. Public-access rules apply, though privacy limits restrict some material, and a general county office cannot override what the holding court decides.

Getting Genesee County Court Records

Before you ask for a Genesee County court record, gather the basics. Bring the court of record, the case number, party names by role, and the exact document or date range you want. Decide whether you need inspection, a plain copy, or a certified copy. MiCOURT Case Search can locate a public case index or register of actions. It does not promise every document image or a certified record. Circuit civil, criminal, and domestic files go to the 7th Circuit Legal Records Division. District case files belong to the 67th District Court Records Department. Probate keeps its own records office.

Genesee County offers several documented routes in. MiCOURT gives you the public index online. Ask the clerk about a public terminal, in-person inspection, current hours, off-site files, and copy charges. Circuit Legal Records publishes phone, fax, and email contacts. The district request form works by mail, email, or fax. The Records Department handles walk-in requests. Call before traveling, since district satellite operations have changed. Michigan FOIA covers certain county administrative records. It is not an automatic substitute for a judicial-file request.

  1. Locate the Genesee County case in MiCOURT or gather the court-issued case number and party names.
  2. Choose the court of record: 7th Circuit, 67th District, or Probate Court.
  3. State whether the request is for inspection, a public copy, a specific document, or certification.
  4. Use the court's online, phone, counter, mail, email, or fax route and ask whether the file is on-site.
  5. Confirm the current fee, payment, pickup, delivery, and any restricted-record limitation with that court.

Genesee County Court Record Access Levels

A Genesee County court record is not one thing. The public search result and the register of actions (ROA) help you identify a case and follow its procedural history. Inspection is different. That means reviewing a public court record at the court itself. A copy is simply a reproduction, while a certified copy is one the clerk authenticates under that court's certification process. Keep in mind that a single case can sit at one public level overall while a particular attachment or identifier stays restricted at another.

Plain copyA reproduction of a public record or specified item.Request from the court of record using its current process.
Certified copyA clerk-authenticated reproduction, when the court can provide it.Request certification from the court that maintains the file.

The 7th Circuit's C07-2024-04J local order governs how court records are accessed, inspected, reproduced, and created under MCR 8.119(H). It also explains why a public Genesee County case index never replaces the clerk's separate role in producing copies or certifications.

Court Record Types

What is inside a Genesee County court record depends on the case. It also depends on the court. A public ROA usually gives procedural entries. A court file can hold pleadings, orders, and other filed material. Not all of that material is public. Audio, transcripts, exhibits, sealed attachments, and older archived files should be requested by name. There is no single universal online repository or release process for these items.

  • Public case index and register-of-actions entries.
  • Pleadings such as complaints, petitions, answers, and motions when public.
  • Orders, judgments, and dispositions maintained in the case file.
  • Hearing settings, notices, and calendar-related entries.
  • Recordings, transcripts, exhibits, and archived material when the court confirms the available route.

Be specific when you ask. A Genesee County records request works best when it names the item you want. Name an order or a recording. That way you are not assuming the record is public or online. A blanket request for a "complete file" at the 67th District Court still runs into the form's condition that no non-public records are available.

Genesee County Court Records by Custodian

Genesee County splits its clerk duties across offices. The Genesee County Clerk/Register of Deeds holds the county constitutional role. But circuit filings go through the Legal Records Division at its public counter. The 67th District Court Records Department is separate. It has its own form, its own contact channels, and its own published copy prices. Probate court records sit in yet another office. So name the court on your request, or it may land with a records office that does not hold the file.

CustodianRecords heldPublic access path

Genesee County Probate CourtEstates, guardianships, conservatorships, and probate or mental-health matters.Contact Probate Court for its records procedure and access limits.

For circuit cases, one counter matters. The Legal Records Division is the official public access point for the circuit court. It handles civil, criminal, and domestic filings. It gives information and referral. It also keeps records under SCAO retention standards. It is not the same office as the 67th District counter or Probate Court.

Inside a Genesee County Court Record

A Genesee County case record can show a lot. Public fields may include the court, case number, case type, status, filing date, parties, assigned judge, setting, register entries, document indicators, disposition, and related-case information. Read it as a procedural record only. An entry tells you what happened on paper, not more. Do not stretch a court record into a claim about facts or an outcome it never states.

Case numberThe court's identifier, safely represented as [YEAR-XX-0000] rather than a real case number.
Parties and rolesRoles such as plaintiff, defendant, petitioner, respondent, complainant, or interested person.
ROAChronological public case-history entries for filings, orders, hearings, and other events.
DocumentsTitle, filing date, public or nonpublic indicator, and link availability where shown. A link is not guaranteed.
Settings and dispositionScheduled date or recorded resolution fields, which must be read with exact date and status.

Michigan court rules shield certain details inside a Genesee County court record. Birth dates, Social Security numbers, and other national-identification data stay protected. So do driver-license or state-ID numbers, passport details, and financial-account information. Seeing a public ROA does not give anyone permission to copy protected items. It does not allow republishing them either. Ask the court about redactions or limits that apply to a specific document.

Genesee County Court Record Request Details

Genesee County's 67th District Court takes record requests on a written form. The 67th District Court records request form asks for the request date, your name, address, best phone number, case number, and party names. Checkboxes let you pick record review or copies. For copies, request the whole public case file or describe the one court record you want. That detail helps Records Department staff locate the right Genesee County file, since a public search result is not the file itself.

District mail goes to 67th District Court, Records Department, 630 S. Saginaw Street, Flint, MI 48502. Or email 67THHELP@GENESEECOUNTYMI.GOV. Fax 810-768-7912 works too. Circuit records are a different office: Legal Records, Room 202, 900 S. Saginaw Street, Flint, MI 48502. Call 810-257-3220 or fax 810-424-4455. Email is clerkslegalstaff@geneseecountymi.gov. Before visiting, ask each office about public terminals, off-site older files, and current hours.

The 7th Circuit's agency court-record request page works differently. It wants agency identifying information, including an ORI, plus the name of the record. Allow five business days, with possible off-site delay. That page serves agencies, not the public.

One warning from the district form is worth heeding. Records not picked up within 30 days may be disposed of, though prepaid orders can get an extension.

Fees and Certified Copies

A certified copy is a clerk-authenticated reproduction of a court record. Skip it unless you truly need one. Confirm the document can be certified. The 67th District Court form publishes those Genesee County district rates. Circuit fees are a different matter. The access counter takes records orders, but no single current circuit fee schedule applies, so confirm the amount directly with Legal Records.

Genesee County Court Record FOIA Split

Michigan's Freedom of Information Act, MCL 15.231 et seq., opens public-body records to requesters. In Genesee County it fits administrative records. Think budgets, resolutions, facilities documents, or nonjudicial correspondence. A judicial case file is another animal. Court records follow their own rules, custodians, redactions, and local procedures.

For a Genesee County court file, start with MCR 8.119 and the court that holds it. County administrative records go through FOIA instead. Keeping the two apart saves headaches. It keeps a court-file request out of an administrative route, and it stops FOIA from being used as a workaround for a seal, a restriction, or clerk certification.

The Michigan Courts' Chapter 8 court-rules source governs public court records statewide. It covers registers, inspection, reproduction, and privacy safeguards.

Genesee County court record access under Michigan Court Rules Chapter 8

Genesee County courts apply the Chapter 8 framework. A judicial case file goes through the court's own records contacts and local order, not a general county FOIA route.

Sealed Records and Public Access

Public Genesee County court records still answer to statutes, court rules, court orders, and privacy redactions. Juvenile matters, adoptions, mental-health matters, name changes, certain personal-protection-order categories, set-aside convictions, and other restricted categories may be missing or limited in a public search. A missing result proves nothing. It does not mean no record exists. The court controls any legally authorized access.

Michigan court-record rules:

MCR 8.119 covers public court records, registers, inspection, reproduction, and protection of personal information.

MCR 1.109(F) protects personal identifying and financial information in court filings.

MCR 3.925 limits access to juvenile files even when there may be a limited public calendar component.

MCL 780.621 governs the current set-aside application framework for qualifying convictions.

An index entry is not permission. Where access is restricted, ask the Genesee County court about inspection, copying, certification, and any court-order procedure for reproducing protected information.

Genesee County Court Records Off-Site

When a Genesee County court record is not online, ask why. Start with the reason. The document may be nonpublic, unscanned, off-site, or archived. It may be held by another court, or sit with a separate source like a court reporter or transcript vendor. Name the document precisely. A transcript, recording, exhibit, or older file may follow a different procedure than a plain ROA request. That procedure may rest with a clerk, judicial officer, reporter, or vendor. The 7th Circuit agency page sets a five-business-day target with possible off-site delay. That applies to agency workflow only. There is no universal public turnaround. The local administrative-orders index also posts court-hours and closure information that can affect counter access. Check clerk hours and pickup rules before you drive over.

Request path: identify the case and item → ask which court holds it → confirm public status and file location → submit the correct request → confirm fee and delivery → request certification if needed.
